Why am I advised not to name the bitch my husband ran off with as co-respondent?
My husband ran off with a woman from his office - black seamed stockings, mock-croc stilletos and pencil skirts - you know the type. I want to file for divorce and name her as co-respondent but my solicitor says this is unwise and strongly advises against it but doesn't seem to give me a good reason. There are no children. My mother named a co-respondent in her divorce from my father so when did the law change? why can't I name a co-respondent now? and when would it be acceptable to name this woman as co-respondent. I have all the evidential photographs and everything.
You can name a co-respondent if you wish but very few matrimonial lawyers will advice you to do so. There is a practical reason for this as leaving the co-respondent unidentified will avoid potential problems with regard to service of the papers and the possibility the co-respondent may file an answer and attempt to defend the proceedings.
