What are the grounds for unreasonable behaviour and if we divorce, is my wife entitled to half my businesses?
On what grounds can I commence divorce proceedings against my wife for unreasonable behaviour and if I proceed to do so what claim will she have on my businesses, to which she has contributed neither time nor any effort?
If you wish to commence proceedings based on your wife's unreasonable behaviour, then you have to ask yourself the question, has your wife behaved in such a way you cannot reasonably be expected to live with her. If the answer is yes, then you can rely on this fact to divorce your wife.
In order to calculate the extent if any of your wife's interest in your businesses and other assets, the court can take into a account a range of factors, to include contribution, financial and otherwise and another relevant factor in your circumstances would be length of marriage, there are other factors as well the court may take into consideration. It is not correct to assume in all cases there is a fifty/fifty split. It all depends on the circumstances of each individual case.
