Non-disclosure of material financial information at time of divorce: can I make a further claim?
I divorced in 2004 and recently discovered that during the financial settlement process my husband inherited a house from his grandmother worth a substantial amount of money. This was never disclosed to me and the divorce went ahead. The court order states that neither parties have any further claim on the other's assess and the financial agreement made is final. Bearing in mind that I was unaware of this inheritance would I now be able to claim?
The court rarely entertains an
application to set aside a previous order imposed by a court, however an application
may be considered in certain circumstances, to include where there has been a
material non-disclosure or misrepresentation.
The fact that your ex husband
failed to disclose his inheritance could amount to just such a material
non-disclosure.
