My wife wants me to leave the house but I have nowhere to go. What should I do?

My wife and I are separating, she wants me to leave the house but I have nowhere to go and can't afford to pay the mortgage or rent on another property. What should I do?

You have as much right to stay there as she does, she cannot make you leave unless you were to behave in a violent or threatening manner towards her, in which case she may be entitled to an Injunction which would bar you from the house for a time at least.

If neither of you can afford to live somewhere else, you can either sell the house and split the proceeds (although you would both have to agree to this) or, alternatively, live together separately under the same roof i.e. separate financial, eating and sleeping etc arrangements.

If one of you has grounds for divorce, a Court can be asked to make an Order once the divorce proceedings are under way for the house to be transferred into one party's name or for it to be sold.
