My ex-husband is refusing to give me our children's passports on the grounds that he paid for them. What can I do?
My ex-husband is refusing to give me our children's passports on the grounds that he paid for them last year in order to take them abroad. I have asked several times to no avail and the Passport Office won't get involved. I have sent a letter and given him seven days for their return otherwise he will be reported to the police for theft. He says it is not a criminal matter but civil and told me to get a solicitor. He wants me to pay half the cost of the passports but I can't afford to.
A Solicitor will be able to write to your ex-husband and ask that the passports be handed over to you on the basis that the children are in your care and you will need them to take the children on holiday. If he fails to do so the Solicitor is likely to suggest to him that you will make an application to the Court for a Specific Issue Order and the thought of Court proceedings and the costs implications may be enough for him to hand them over.
