My 14 year old daughter has asked if she could come and live with me. My partner and I have both said yes but her mother flatly refuses to let her move out. Does my daughter have any rights reguarding where she lives?
If you and your daughter’s mother are unable to agree as to what is in the best interests of your daughter, then you can consider making an application to the Court for a residence Order. Within those proceedings the best interests of your daughter will be considered taking into account a range of circumstances, one of which is your daughter’s wishes and feelings. At fourteen your daughter should have a voice but it is impossible to advise how much weight the Court will apply to her wishes without knowing all the facts.
