I started up my own business three months ago with no help from my wife. Six weeks ago we split up and my wife moved out and left our three children with me. She is now saying that she wants half of my business. Is she entitled to this?
Given that you have started your business very recently it is unlikely to have a very high value, so unless she contributed to it financially it is improbable that she would be awarded any interest in it. In addition, if it is your main source of income, a Court would not normally order it to be disposed of just to realise a sum of money for her. She is much more likely to have a claim on other matrimonial assets, e.g. the matrimonial home.
