Can I divorce in the UK even though I live abroad?
I have been resident in Dubai for the three years and do not wish to come back onshore for tax reasons. My ex-wife left the marital home and is resident in London. She says she does not wish to divorce at this time. Can I petition for divorce against her or will my residency prohibit this?
Provided you have the grounds, the
fact that your wife is resident in London is sufficient to satisfy
the requirements to issue proceedings under the law in England and
Wales.
You may still be domiciled in England and Wales also despite being resident in Dubai, which will also entitle you to petition for divorce in England and Wales.
