After four months my marriage is a disaster: how soon can I divorce my adulterous husband?

I got married after a whirlwind romance and after four months the marriage has turned out to be a disaster. My husband is having an affair with a previous long time girlfriend and not even trying to conceal it. He moved in with me before we married and I want rid of him as soon as possible. I have asked him to leave the flat and he has agreed (to move in with the other girl) but how soon can I divorce him?

No one can apply for a divorce until you have been married for at least a year. There are no exceptions to this rule and while you can (and by the sounds of it should) separate you will not be able to file for divorce until one year has passed since yuo got married which means your divorce will not come through until at least 15 months after you married.

It seems clear that your husband has committed adultery and you should be able to rely on this as grounds for divorce.

Once the one year period is up you can file for divorce and File4Divorce solicitors will assist you in this for £400 plus VAT plus disbursements. Given that your husband moved in with you it is important you seek legal advice over the financial settlement.

If you would like to discuss this in confidence with a lawyer at no initial cost, please call my colleague Clare Hudson, our matrimonial solicitors' team leader direct on freephone 0800 066 99 20 or alternatively email me with a convenient time and day and we will call you back on the number you provide.
